Resumen

In this paper, the authors examine the reasons that led to the inclusion in the UNCITRAL Model Law the regulations for the recognition and enforcement of precautionary measures issued by foreign arbitral tribunals since courts do not recognize the application of the New York Convention. In this context, they analyze the latin American regulation and a recent Peruvian court ruling, which recognizes a precautionary measure issued by a foreign arbitral tribunal.
