Regulation of monopolistic ports in Peru: the 2004 Matarani tariff review

Abstract

With experiences in only a handful of countries, port regulation is a relatively unknown discipline. In Peru, OSITRAN, the regulator for transport infraestructure, has developed a framework that applies to all transport infraestructures (ports, airports, roads and railways) and ensures that tariffs are regulated only in markets where competition cannot be introduced. In 2004, it used this framework to review the tariffs charged at Matarani, the only concessioned port in the country. Regulation using RPI-X in an environment characterizad by low levels of demand, limited but existing competition and scarcity of data in a mostly state-owned industry, posed several methodological dilemmas. The authors consider that the decisions taken by OSITRAN for the 2004 Matarani tariff review may serve as a parameter for regulators facing similar limitations.
