Abstract

In this paper, the author analyzes the emergence of Environmental International Law as an autonomous branch of the International Law within the framework of International Justice Court’s jurisprudence (IJC). Thus, he delves deep into the environmental damage derived from the use of nuclear weapons and the state customary obligations in environmental law regarding to other States’ territories. Finally, he examines a recent IJC jurisprudence that introduces new legal norms in connection with the frontier damage.
