Condenados a una pena privativa de la salud: la crisis carcelaria en tiempos del coronavirus

Abstract

The prison issue was one of the most critical of the emergency unleashed by the Covid-19 pandemic in Peru, as it is a problem that required urgent actions by the State as a whole, both the Executive Power and the Judicial Power and of the Legislative. For this reason, in the face of the health crisis in prisons, it is worth wondering if something else could be done, or something different, than what was done with the Peruvian prison system, to better face its lethal effects. In this chapter, we will first analyze what was the response of the State, especially the Executive, to the pandemic, to later indicate what could or should have been done, once the disease was detected in Peru.
